CD Projekt Red has confirmed that they have received second class-action lawsuit regarding Cyberpunk 2077 and its poor performance on last-gen consoles. The developer said it is similar to the first lawsuit with the “content of the claim, including its subject and scope, is the same as the one disclosed by the Company in Current Report 68/2020 of 25 December 2020.” Like the first lawsuit, CD Projekt Red states that “the complaint does not specify the quantity of damages sought” and that they will undertake vigorous action to defend itself against any such claims.
Weeks after the release of Cyberpunk 2077 and the backlash from its poor performance on last-gen consoles, which led to the game being delisted from the PlayStation Store and refunds being sent, there were reports that CD Projekt Red would be getting lawsuits filed against them from investors. The investors believe that CD Projekt Red “mislead” and the game that was presented was “materially false” because of how poor the game ran on PlayStation 4 and Xbox One. According to reports, there are at least four potential lawsuits that will be filed against CD Projekt Red so it’s possible more may come in the future.
In addition to the lawsuits, CD Projekt Red is also being investigated by the Polish Office of Competition and Consumer Protection. They are checking to see how CD Projekt Red is fixing the game and making sure it can run on the last-gen consoles after receiving complaints of dissatisfaction because they couldn’t play the game on their equipment despite the manufacturer’s, in this case, CD Projekt Red’s, earlier assurances. If the Office of Competition and Consumer Protection sees that CD Projekt Red is at fault, they may receive a fine, but nothing has been announced yet.
Last week, CD Projekt Red Co-Founder Marin Iwinski released an apology and new roadmap for future Cyberpunk 2077 updates. They will continue to focus on releasing patches to help get rid of the bugs and glitches that have plagued the game. Afterward, they will focus on the free DLCs that they planned for as well as the next-gen console update for PlayStation 5 and Xbox Series X|S which won’t be released until later in the Fall of 2021.
