Developer Xreal LLC has run into quite the snafu with popular video game publisher Bethesda. Yesterday Jordan Maron, developer for Xreal, announced on his YouTube channel that they had received a cease and desist letter from the publisher’s legal team regarding Xreal’s current game Fortress Fallout.
The legal action stems from the games name itself, as Bethesda has trademark rights over their popular gaming series Fallout. Both Fortress Fallout and the Fallout series are two entirely different entities aside from the use of Fallout in the games titles. Bethesda’s series is an RPG based game set in a post apocalyptic world, while Xreal’s Fortress Fallout is a mobile game that focuses on competitive tower building; expected to be released sometime this year.
After advisement from Xreal’s legal counsel, Maron stated that it would be in the developers best interest to rename the title. Though they have the option to prove that both titles are two completely different projects, it would be futile against such a large corporation. Now developers are giving their fans a chance to rename the project in hopes that it will resolve this matter.
The whole ordeal is absurd and even had Jordan Maron stating his frustration towards the letter.
“It’s pretty silly. Congratulations Bethesda. You won. You beat us. You showed us who’s boss.”
